Acceptance of Terms

These Terms of Service ("Terms") form a legally binding agreement between you ("User", "you") and KaceFarms Ltd ("KacePro", "we", "us", "our"), a company registered in Ghana.

By downloading, installing, or using the KacePro mobile application or visiting kacefarms.com, you confirm that you have read, understood, and agreed to these Terms and our Privacy Policy.

If you do not agree to these Terms, do not use KacePro. If you are using KacePro on behalf of a business or organisation, you represent that you have authority to bind that entity to these Terms.

The Service

KacePro is a farm management mobile application that allows livestock and poultry farmers to:

• Record daily population, egg production, and feed consumption
• Track vaccination schedules and receive push notifications
• Manage sales, purchases, and farm expenses
• Generate financial reports and farm analytics
• Manage farm staff with role-based access controls

KacePro is available as an Android mobile application and is accessed via our API at kace.kacefarms.com. An internet connection is required to sync data.

We reserve the right to add, modify, or remove features at any time. Where a change materially reduces the service, we will give reasonable notice to active subscribers.

Your Account

To use KacePro you must create an account by registering your farm. You agree to:

• Provide accurate and complete information when registering
• Keep your password confidential and not share it with anyone outside your farm team
• Notify us immediately at hello@kacefarms.com if you suspect unauthorised access to your account
• Take responsibility for all activity that occurs under your account
• Ensure that team members you add (supervisors, staff) comply with these Terms

You may add multiple users to your farm account within your plan's user limit. The farm owner is responsible for managing user access and removing team members who leave the farm.

We reserve the right to suspend or terminate accounts that violate these Terms, provide false information, or engage in fraudulent activity.

Subscriptions & Payments

KacePro is offered on a subscription basis. Plans are billed monthly or yearly as selected at signup. Current pricing is shown on our pricing page.

Billing:

• Payments are processed securely by Paystack. We do not store your card details.
• Subscriptions renew automatically at the end of each billing period unless cancelled.
• You will be notified before any price change takes effect.
• Prices are shown in Ghana Cedis (GHS). Other currencies may be available depending on your location.

Cancellation:

• You may cancel your subscription at any time from the app settings.
• Your account remains active until the end of the current billing period.
• No refunds are issued for partial billing periods unless required by law.
• After cancellation, your data is retained for 90 days before permanent deletion.

Failed payments: If a payment fails, we will notify you and attempt to retry. If payment is not resolved within 7 days, your account may be downgraded or suspended until payment is made.

Your Farm Data

Your farm data — including batch records, daily recordings, financial records, and customer information — belongs to you.

• We do not claim ownership of any data you enter into KacePro.
• You grant us a limited licence to store, process, and display your data solely for the purpose of providing the KacePro service.
• We will never sell, share, or use your farm data for any purpose other than operating the service as described in our Privacy Policy.
• You may request a full export of your data at any time by contacting hello@kacefarms.com.
• You are responsible for the accuracy of data you enter and for maintaining appropriate backups of critical records.

You warrant that any data you upload or enter into KacePro does not infringe the rights of any third party and complies with applicable laws.

Acceptable Use

You agree to use KacePro only for its intended purpose — managing your livestock farm. You must not:

• Use KacePro for any unlawful purpose or in violation of any applicable law or regulation
• Attempt to gain unauthorised access to any part of the service, servers, or databases
• Reverse engineer, decompile, or attempt to extract the source code of the application
• Use automated scripts, bots, or tools to scrape, crawl, or overload our servers
• Resell or sublicence access to KacePro to third parties without our written permission
• Enter false, misleading, or fraudulent data into the system
• Impersonate any person or entity or misrepresent your affiliation with any person or entity
• Use the service in any way that could damage, disable, or impair the platform for other users

Intellectual Property

KacePro, including the application, website, design, logos, code, and all content created by KaceFarms Ltd, is the intellectual property of KaceFarms Ltd and is protected by copyright and other applicable laws.

• You are granted a limited, non-exclusive, non-transferable licence to use the KacePro app for your own farm management purposes.
• This licence does not include the right to copy, modify, distribute, sell, or create derivative works from KacePro.
• The KacePro name, logo, and brand marks are trademarks of KaceFarms Ltd. You may not use them without our written permission.

Service Availability

We aim to keep KacePro available 24 hours a day, 7 days a week. However, we do not guarantee uninterrupted access. The service may be temporarily unavailable due to:

• Scheduled maintenance (we will give advance notice where possible)
• Unplanned technical issues or server failures
• Circumstances beyond our control (force majeure) such as internet outages, natural disasters, or third-party service failures

We will make reasonable efforts to restore service promptly in the event of an outage. We are not liable for any loss or inconvenience caused by temporary unavailability of the service.

We recommend that all users maintain their own records of critical farm data as a backup, and not rely solely on KacePro as the single source of truth for time-sensitive decisions.

Limitation of Liability

KacePro is provided on an "as is" and "as available" basis. To the fullest extent permitted by law:

• We make no warranties, express or implied, regarding the accuracy, reliability, or completeness of the service.
• We are not responsible for any loss of data, loss of profits, loss of revenue, or any indirect, incidental, or consequential damages arising from your use of KacePro.
• Our total liability to you for any claim arising out of or relating to these Terms or your use of KacePro shall not exceed the total subscription fees paid by you in the 3 months preceding the claim.
• We are not liable for any decisions you make based on data or reports generated by KacePro. Farm management decisions remain your responsibility.

Termination

By you: You may stop using KacePro and cancel your account at any time from the app settings or by contacting us. Cancellation does not entitle you to a refund for any unused portion of the current billing period.

By us: We may suspend or terminate your account if you:

• Violate these Terms of Service
• Fail to pay subscription fees after reasonable notice
• Use the service in a way that poses a security risk or legal liability
• Provide false information during registration

Where termination is due to a breach by you, no refund will be issued. Where we terminate for other reasons, we will refund any unused prepaid subscription fees on a pro-rata basis.

Upon termination, your right to use KacePro ceases immediately. Your data will be retained for 90 days after which it will be permanently deleted. You may request an export of your data before deletion by contacting us at hello@kacefarms.com.

Changes to These Terms

We may update these Terms from time to time to reflect changes in our service, legal requirements, or business practices.

When we make material changes we will:

• Update the "Last updated" date at the top of this page
• Send a notification to your registered email address at least 14 days before the change takes effect
• Display an in-app notice when you next open KacePro

Your continued use of KacePro after the effective date of revised Terms constitutes your acceptance of the changes. If you do not agree to the new Terms, you must stop using the service before the effective date.

Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of the Republic of Ghana, without regard to conflict of law principles.

Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation. If a dispute cannot be resolved within 30 days of written notice, it shall be submitted to the courts of Ghana.

If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.
